Terms and Conditions

Scope of Application

These Terms and Conditions apply to all contracts, deliveries and other services ("Contracts") between Global Edit Agency, Owner: Sam Groß, Ilandkoppel 29, 22337 Hamburg, Germany (hereinafter "Provider"), and their contractual partners ("Customer").

The Terms and Conditions apply exclusively to entrepreneurs (§ 14 BGB). Terms and conditions of the customer are not recognized unless the provider expressly agrees to their validity in writing.

1. Contractual Partners & Conclusion of Contract

The contractual partners are the provider and the customer who books a service ("Service") via the website https://www.globaleditagency.com (or by offer/confirmation).

The presentation of services on the website does not constitute a legally binding offer, but rather a non-binding service overview. A binding contract only comes into existence through an order confirmation by email or through processing of payment (e.g. via Stripe checkout).

2. Service Description

The provider provides digital marketing and creative services for real estate professionals, in particular:

• Photo Perfection: AI-powered image optimization
• AI-Crafted Video Showcases: Creation of 30s / 60s / 90s video tours from provided photos
• Copy & Social Media Toolkit: Creation of listing texts, social media assets and templates

The exact scope of services (scope, number of images, video length, revisions, delivery time) depends on the selected tariff or individual offer.

3. Prices & Payment

The prices stated on the website and in the order confirmation apply in EUR or USD.

Payment is made exclusively in advance via Stripe. Other payment methods require a separate agreement.

All prices are net plus applicable VAT. As an entrepreneur with VAT ID, the customer may claim intra-community delivery.

4. Delivery & Service Period

The standard delivery period is 24 hours from receipt of payment ("24 h Delivery"), unless otherwise agreed.

For express services (12 h Express), the conditions specified in the tariff apply.

The period begins with complete receipt of all required materials (photos, briefings) by the provider and ends with provision of the finished material via download link/email.

5. Customer's Obligations to Cooperate

The customer provides all required photos, texts and any brand logos in print and web-ready quality in a timely manner.

Delays due to missing or defective data are not within the provider's responsibility and extend the delivery periods accordingly.

6. Right of Withdrawal / Cancellation

Entrepreneurs have no statutory right of withdrawal or cancellation. If a right of withdrawal is nevertheless granted (e.g. for natural persons), we refer to our withdrawal instructions, which are provided separately.

If the provider begins the service before the end of the withdrawal period and the customer has expressly agreed to this, the right of withdrawal expires completely upon conclusion of the contract.

7. Warranty

The statutory warranty for defects applies: Entrepreneurs must report obvious defects immediately, at the latest within 7 days after acceptance/download in writing.

If subsequent performance (rectification or replacement delivery) fails, the customer may initially demand a reduction in price (reduction) or withdrawal.

8. Liability

The provider is liable without limitation for intent and gross negligence.

For slight negligence, the provider is only liable in case of breach of a cardinal obligation (essential contractual obligation), limited to the typically foreseeable damage.

Liability under the Product Liability Act remains unaffected.

9. Usage and Copyright

The provider grants the customer an exclusive, temporally and spatially unlimited right of use to the delivered end products (images, videos, texts).

Copyright and related rights to the raw material and the AI models used remain with the provider.

The customer may not edit or resell the delivered products unless otherwise agreed in writing.

11. Final Provisions

Applicable law is German law excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for all disputes arising from this contract is, insofar as the customer is a merchant, Hamburg.

Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.
